Consultation with local communities
The T-704 ruling issued by Colombia’s Constitutional Court established a series of obligations for Cerrejón to engage with communities on impacts associated with its operations and agree on mitigation and compensation measures, a process that has strengthened the company’s engagement with Wayuu communities. In Media Luna, the ruling initiated an extensive consultation process with the 16 communities that live near Puerto Bolívar. This process required a structured dialogue, clear information sharing and consensus-building on the types of compensation and investments that would best respond to local priorities.
Reaching these agreements has not been simple. The consultation process has spanned several years and required navigating Wayuu governance dynamics, territorial considerations and community expectations. However, it has also enabled the joint development of a roadmap that today guides much of Cerrejón’s social investment in the area.
Under the T-704 process, communities selected a diverse set of initiatives rooted in their cultural practices, economic activities and communal life. More than 93 projects have been implemented, including the provision of fishing kits and boats, artisanal materials, livestock for income-generation, improvements to cemeteries, construction of traditional kiosks and other culturally significant structures, and support for traditional authorities.
These initiatives reflect both practical needs and cultural values. Fishing is a primary livelihood in Media Luna, making equipment and training essential for stability and safety. Artisanal activities and livestock support household incomes and reinforce traditional skills. Investments in cemeteries and traditional kiosks respond to customs that structure social life, including gatherings, ceremonies and rituals associated with the life cycle.
The ruling also formalized the expectation of continuous dialogue. As a result, the company and communities established a joint working group bringing together the communities that are part of Media Luna, which meets regularly to monitor progress, share information and address concerns. This mechanism has contributed to greater transparency and predictability, allowing issues such as employment, water access or project timelines to be addressed collectively rather than through ad hoc interactions.
Another important outcome of the T-704 process has been the strengthening of local leadership. Community authorities played a central role in setting priorities and approving specific projects. Their participation has helped ensure that investments reflect local preferences and that benefits are distributed in culturally appropriate ways. The process also encouraged the development of community enterprises, which now execute many of the construction and infrastructure projects associated with social investment.
While T-704 was initially a judicial requirement, in Media Luna it has evolved into a broader framework for cooperation. The projects implemented under the ruling, the mechanisms created to support dialogue and the organizational capacities developed along the way continue to shape how communities and Cerrejón work together. Understanding T-704 is therefore essential for understanding the broader development model that is now taking shape in Media Luna.
